Welcome to Hostly Limited (Hostly, we, our, or us). These Terms and Conditions (Terms) govern your access to and use of the Hostly Software-as-a-Service (SaaS) platform, website, mobile applications, and related services (collectively, the Platform). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not access or use the Platform.

2. Nature of the Service
Hostly is a technology intermediary providing lawful scheduling, payment, and service management tools. Hostly does not employ, manage, or represent Contractors, does not act as a financial institution or escrow service, and does not endorse any specific service offered by Contractors. All engagements occur directly between verified Contractors and Customers under mutual agreement.
3. Account Registration & Verification
All Users must create an account and complete Know-Your-Customer (KYC) verification before conducting financial transactions. Hostly may request additional identity or business documentation as required by PSPs or regulatory authorities. Users are responsible for maintaining the confidentiality of login credentials and all activities performed under their account.

5. Cancellations & Refunds
Users may cancel appointments or request refunds in accordance with Hostly’s Refunds and Cancellations Policy. Refunds are granted only when there is a verified billing error, a service malfunction, or when PSP policies allow it. Hostly does not offer refunds for completed or active appointments unless legally required.
6. Payments & Payouts
All transactions are processed exclusively via regulated PSPs supporting Visa, Mastercard, and bank transfers. Hostly does not hold or pool user funds. Payment states include Pending, Available, Withdrawing, Settled, and Refunded. Withdrawals typically process within 1 to 5 business days depending on the PSP. Compliance holds may apply for verification or risk review.
7. Compliance & Lawful Use
Users must comply with Hong Kong’s PDPO, AML and CTF regulations, and any relevant international compliance standards. Prohibited activities include adult or sexually explicit services, investment or MLM schemes, gambling or betting, illegal or restricted goods or services, cryptocurrency or unregulated transactions, and off-platform payments or attempts to bypass Hostly. Hostly may suspend or terminate accounts engaged in prohibited conduct or violations.
8. Data Protection & Security
Hostly uses end-to-end encryption, two-factor authentication (2FA), and role-based access controls. Data is stored and processed in compliance with PDPO and retained for a minimum of five years as required by PSPs and legal obligations.
9. Intellectual Property
All software, content, trademarks, and materials on the Platform belong to Hostly Limited or its licensors. Users may not copy, modify, distribute, or reverse-engineer any part of the Platform without written consent.
10. Limitation of Liability
Hostly is not liable for indirect, incidental, or consequential damages. Services are provided as is with no guarantee of uninterrupted or error-free operation. Contractors and Customers are solely responsible for the legality, quality, and accuracy of their interactions and transactions.
11. Indemnification
Users agree to indemnify and hold Hostly, its directors, employees, and affiliates harmless from any claims resulting from breaches of these Terms, misuse of the Platform, or violations of any laws or third-party rights.
12. Suspension or Termination
Hostly may suspend or terminate accounts without notice if fraud or unlawful activity is suspected, if PSPs or regulators request account action, or if the User breaches these Terms or Hostly’s compliance framework.
